Outprobe Terms of Service

1. Agreement to Terms

By creating an account or using Outprobe ("the Platform"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use Outprobe.

2. Eligibility

  • You must be at least 13 years old (or the minimum age required by your country's laws) to use Outprobe.
  • You must provide accurate information when creating your account.
  • You are responsible for maintaining the security of your account credentials.
  • One person, one account. Multiple accounts are not permitted.

3. Your Account

3.1 Account Creation

To use Outprobe, you must create an account with a valid email address. You are responsible for all activity that occurs under your account.

3.2 Account Security

You must:

  • Use a strong, unique password
  • Not share your account credentials with anyone
  • Notify us immediately if you suspect unauthorized access to your account

We are not liable for any loss resulting from unauthorized use of your account.

3.3 Account Deletion

You may delete your account at any time from your account settings. Upon deletion:

  • Your personal data will be permanently deleted within 30 days
  • Your posts in communities may be anonymized (shown as "Deleted User")
  • Your community memberships will be removed
  • Communities you own will be transferred to the next admin, or deleted if no admin exists
  • This action is irreversible

4. Communities

4.1 Creating Communities

  • Free users may create up to 2 communities
  • Outprobe Premium users may create up to 5 communities
  • Each community receives 4 GB of storage by default
  • Storage and member limits can increase through Explorer Stones (community boosts)

4.2 Community Types

4.3 Community Tiers (via Explorer Stones)

Communities can be boosted by members using Explorer Stones. Higher tiers unlock increased limits:

Upload limits per file also increase with tier: 10 MB (Base), 25 MB (Tier 1), 50 MB (Tier 2), 100 MB (Tier 3).

4.4 Community Ownership

  • The community creator is the owner
  • Owners may transfer ownership to another member
  • Owners may appoint admins and moderators
  • Owners are responsible for enforcing community rules and Outprobe's content policies within their community
  • Outprobe reserves the right to remove communities that violate these Terms

4.5 Community Storage

  • Storage is shared across all content in the community (posts, media, documents)
  • When storage is full, new media uploads are blocked until storage is freed or the tier is increased
  • Text posts and comments do not count toward storage

5. Outprobe Premium

5.1 Features

Outprobe Premium is an individual subscription that provides:

  • No advertisements anywhere on the platform
  • Ability to create up to 5 communities (instead of 2)
  • Circle member limit increased to 180 (free: 160)
  • 3 Explorer Stones per month to boost communities
  • Additional features as announced

5.2 Pricing

Outprobe Premium is offered with regional pricing to ensure accessibility worldwide. Current prices are displayed in the app and on our website. Prices may vary by country and are shown in your local currency.

5.3 Billing

  • Premium is billed monthly or annually, depending on your chosen plan
  • Payment is processed via Google Play Billing (Android) or our direct payment gateway (web, when available)
  • Your subscription automatically renews unless cancelled before the renewal date
  • We do not store your payment card details

5.4 Cancellation and Refunds

  • You may cancel your Premium subscription at any time from your account settings
  • Upon cancellation, you retain Premium benefits until the end of your current billing period
  • After expiration (graceful degradation — we never delete your data):
    • You will see ads again (if using free communities)
    • Your community creation limit returns to 2 (existing communities beyond the limit remain but you cannot create new ones)
    • Your circle member limit returns to 160 (existing members stay, but you cannot add new ones until at or below 160)
    • Explorer Stones you placed are removed at the end of your billing period; communities may drop tiers as a result
  • Refunds are handled on a case-by-case basis; contact support@outprobe.com

5.5 Price Changes

We may change Premium pricing with at least 30 days notice. Existing subscribers will be notified before any price change applies to their subscription.

6. Explorer Stones

6.1 What Are Explorer Stones

Explorer Stones are a community boost system. Premium members receive 3 stones per month and can place them on communities they want to support.

6.2 How Stones Work

  • Stones are earned through an active Premium subscription (3 per month)
  • You can place stones on any community you are a member of
  • Stones contribute to a community's tier level
  • You can redistribute your stones at any time (remove from one community, place on another)

6.3 Stone Expiration

  • Stones remain active as long as you maintain an active Premium subscription
  • If your Premium subscription expires or is cancelled, your stones are removed from all communities at the end of your billing period
  • This may cause communities to drop tiers if they fall below the stone threshold

6.4 Stones Are Not Currency

  • Explorer Stones cannot be purchased individually (they come only with Premium)
  • Stones cannot be traded, sold, or transferred between users
  • Stones have no monetary value and are not redeemable for cash

7. Content and Conduct

7.1 Your Content

You retain ownership of all content you create and post on Outprobe. By posting content, you grant Outprobe a limited, non-exclusive license to:

  • Display your content on the platform
  • Store your content on our servers
  • Distribute your content to community members and your circles as directed by your sharing settings
  • Create thumbnails and previews of your media

This license ends when you delete your content or your account.

7.2 Prohibited Content

You may NOT post, share, or distribute:

Illegal Content:

  • Content that violates any applicable law
  • Child sexual abuse material (CSAM) — reported to authorities immediately
  • Content promoting terrorism or violent extremism
  • Content facilitating illegal drug trade

Harmful Content:

  • Credible threats of violence against individuals or groups
  • Content promoting self-harm or suicide
  • Non-consensual intimate imagery (revenge porn)
  • Doxxing (sharing private personal information without consent)

Abusive Content:

  • Targeted harassment or bullying of individuals
  • Hate speech targeting protected characteristics (race, ethnicity, religion, gender, sexual orientation, disability)
  • Spam, scams, or phishing attempts
  • Impersonation of other people or organizations

Intellectual Property:

  • Content that infringes copyright, trademark, or other intellectual property rights
  • Unauthorized distribution of copyrighted material

7.3 Content Moderation

  • Community owners and their moderation teams are the first line of moderation
  • Outprobe provides tools for community moderators (content removal, member management)
  • Outprobe reserves the right to remove content that violates these Terms, regardless of community rules
  • Users can report content that violates these Terms
  • Repeated violations may result in account suspension or permanent ban

7.4 Conduct Rules

You agree to:

  • Treat other users with respect
  • Follow individual community rules in addition to these Terms
  • Not manipulate platform features (fake accounts, engagement farming, stone manipulation)
  • Not attempt to circumvent platform limits or restrictions
  • Not use automated tools or bots without explicit permission from Outprobe
  • Not reverse-engineer, scrape, or exploit the platform

8. Intellectual Property

8.1 Your Content

You own your content. Outprobe claims no ownership over anything you create or upload.

8.2 Outprobe's Property

The Outprobe platform, including its design, code, branding, and features, is owned by Outprobe. You may not copy, modify, or distribute any part of the platform without permission.

8.3 DMCA / Copyright Policy

If you believe content on Outprobe infringes your copyright:

  1. Send a notice to dmca@outprobe.com with:

    • Identification of the copyrighted work
    • URL or location of the infringing content
    • Your contact information
    • A statement of good faith belief
    • A statement under penalty of perjury that you are the rights holder
    • Your physical or electronic signature

  2. We will review and take action within 10 business days

  3. We will notify the content creator and provide an opportunity to file a counter-notice

  4. Repeat infringers will have their accounts terminated

9. Marketplace (Future Feature)

9.1 Overview

The Outprobe Marketplace allows community members to list items for sale and purchase from other members within their communities.

9.2 Terms

  • Outprobe is a platform connecting buyers and sellers; we are not a party to any transaction
  • Sellers are responsible for the accuracy of their listings
  • Buyers and sellers are responsible for completing transactions
  • Outprobe charges a commission on completed sales (rate displayed at time of listing)
  • Outprobe is not responsible for the quality, safety, or legality of items listed
  • Disputes between buyers and sellers should first be resolved between the parties; Outprobe may mediate but is not obligated to

10. Advertising

10.1 How Ads Work

  • Contextual ads are displayed in community feeds for free users
  • Ads are targeted based on community topic/category, NOT on individual user data
  • Ads are clearly labeled as "Promoted"
  • Ads appear only in community feeds, never in messages, profiles, or community detail screens

10.2 Removing Ads

  • Subscribe to Outprobe Premium (removes all ads for you personally)
  • Boost a community to Tier 2+ with Explorer Stones (removes ads for the entire community)

10.3 Community Owner and Ads

  • Community owners cannot toggle ads on or off
  • Ads are part of the free platform and fund its operation
  • Premium subscription communities (future feature) do not show ads

11. Premium Communities (Future Feature)

This feature will be available once Outprobe integrates its own payment gateway (Stripe/Razorpay). It is NOT available at launch.

11.1 Overview

Community owners may set a monthly subscription fee for their community. Members pay to access the community and its content.

11.2 Revenue Split

  • 90% goes to the community owner/creator
  • 10% goes to Outprobe as a platform fee
  • Payments are processed through Outprobe's own payment gateway (not app stores) to ensure the full 90% reaches creators

11.3 Tier

Premium Communities are automatically Tier 3 — unlimited members, 50 GB storage, 100 MB uploads, original quality media, and Gold Verified badge. No Explorer Stones required.

11.4 Terms

  • Premium communities do not show ads
  • Owners must comply with all Outprobe Terms and content policies
  • Outprobe reserves the right to suspend premium communities that violate Terms
  • Subscription management and refunds are handled through the platform
  • Owners are responsible for any tax obligations on their earnings

12. Limitation of Liability

12.1 The Platform Is Provided "As Is"

Outprobe is provided on an "as is" and "as available" basis. We do not guarantee:

  • Uninterrupted or error-free service
  • That content posted by users is accurate or reliable
  • That the platform will meet all your requirements

12.2 Our Liability Is Limited

To the maximum extent permitted by law, Outprobe shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of data, revenue, or profits
  • Damages arising from user-generated content
  • Damages exceeding the amount you paid to Outprobe in the 12 months preceding the claim

12.3 Indemnification

You agree to indemnify Outprobe against any claims, damages, or expenses arising from your use of the platform, your content, or your violation of these Terms.

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal claim, you agree to contact us at legal@outprobe.com and attempt to resolve the dispute informally for at least 30 days.

13.2 Governing Law

These Terms are governed by the laws of [Jurisdiction — to be determined based on company registration].

13.3 Jurisdiction

Any formal disputes will be resolved in the courts of [Jurisdiction].

14. Changes to These Terms

  • We may update these Terms from time to time
  • Material changes will be communicated via email and in-app notification at least 30 days in advance
  • Continued use of the platform after changes take effect constitutes acceptance
  • If you disagree with changes, you may delete your account

15. Termination

15.1 By You

You may stop using Outprobe and delete your account at any time.

15.2 By Outprobe

We may suspend or terminate your account if you:

  • Violate these Terms or our content policies
  • Engage in illegal activity on the platform
  • Attempt to exploit, hack, or compromise the platform
  • Create multiple accounts
  • Engage in systematic abuse or manipulation

We will provide notice and explanation when possible, but reserve the right to act immediately for severe violations (illegal content, security threats).

15.3 Effect of Termination

Upon termination:

  • Your access to the platform is revoked
  • Your personal data will be deleted within 30 days
  • Your content in communities may be anonymized
  • Any active Premium subscription will not be refunded for the remaining period
  • Explorer Stones will be removed from communities

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy and Advertising Policy, constitute the entire agreement between you and Outprobe.

16.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

16.3 No Waiver

Failure to enforce any provision does not constitute a waiver of that provision.

16.4 Assignment

You may not assign your rights under these Terms. Outprobe may assign its rights in connection with a merger, acquisition, or sale of assets.
